Khums is the Fifth branch of Furoo e din and it is Wajib on every Muslim. Khums, in Islamic terminology means one fifth of certain things which a person acquires as wealth and which must be paid as an Islamic Tax.
Allah says in the Holy Qur'an:
"Know that whatever of a thing you acquire (Ghanimat), a fifth of it is for Allah, for the Messenger, for the near relatives, the orphans, the needy and wayfarer." (al Anfal 8:41)
The money of Khums has to be divided into two equal parts.
One part, i.e. 1/2 is given to needy Sehme Sadaat (persons from the family of the Holy Prophet (S)). (You are allowed to give it to any deserving syed.
Mistakes we do:
- We give it to some Scholars,who is not a nayab e Marja e Taqleed).to distribute to deserving person. (It is your khums and better to spare time in searching poor syed personally). No scholar is masoom.
- We give it to any scholars who wear black turban without thinking or varifying if he is a syed or not and also if he falls in the category of poor syed?
- Some Khojas do mistake by considering all the non Khoja shia ,a Syed and give it to any sheikh, khan, ansari(non syed).
Few highlight of Sayyed (sadat e fatima (s.a) , Khums (sahm e sadaat) and Sadqa issue.
1) Sahme Sadaat is a right of poor syyied (shia ithna asheri syed). Poor means who do not have money for one year expences.
2) Must be given sehme sadat for not more than one year’s of his/her expenses
3) Never give Khums to those sadaat who omit salat,drunkard,committing sins openly such as shaving beard, not observing hijab etc
4) You can give haq e sadat to a traveler syed who has no money to continue his journey back to his home.
5) Distribute it personally by finding true syed personally.You can give the sihmu 's-sadat to a deserving sayyid directly without channeling it through the mujtahid. According to Ayatullah al-Khu'i, you do not even need to ask for his permission in distribution of sihmu 's-sadat. Although Ayatullah al-Gulpaygani believes that even sihmu 's-sadat must be channeled through the mujtahid, he has given a general permission to all those who follow him to distribute sihmu 's-sadat directly.
The second part, i.e. 1/2 is given to Sehme Imam, i.e. the Imam of the time. At present in the Ghaibat of the Imam (A) this part of the Khums has to be given to most learned and trustworthy Mujtahid. He is Mujtahid whose taqlid we do. With his permission we use this money for other purposes, like building Mosques, Madressas, etc.
Mistakes we do:
- We give it to any organisation, Idara who said they have Ijaza, without varification. Laways varify, period of Ijaza, Limit of Ijaza and ask proper reciept Issued by your Marja e taqleed.

I ask Allah The Most High, The Omnipotent to always guide & support you.
In response to inquiries from Momineen, we emphasize once again that paying Islamic dues to whoever holds an authorization (Ijaza) is not sufficient. A demand for a receipt issured by us(ayatullah sistani or him or any of his Liaison officers(nayab)) must be made [to the person receiving the Islamic dues]. Bearing in mind that discrepancies in adhering to the Ijaza may occur either through forgetfulness, error or similar situations. A clear conscience by the payer (of Islamic dues) cannot be attained unless a receipt is obtained as above.
I ask Allah The Blessed The Most High to grant everyone that which is good and beneficial.
